Accion De Tutela Contra Almacenes El Lobo Instaurada Por Extrabajador Que Cotizo Para Pension Por Periodo Que La Entidad No Le Certifica, Vulnerando Su Derecho De Petición. El Juzgado Nego La Accion Interpuesta Por Cuanto Al Entidad Demandada, Es Un Particular Que No Presta Un Servicio Publico, Y Por Cuanto El Derecho De Peticion Aun No Se Encuentra Reglamentado En Relacion Con Los Particulares. Se Omitio Por Parte Del Juzgado La Notificacion En Legal Forma De La Iniciación Del Proceso De Tutela Al Representante Legal De Almacenes El Lobo, Negandose Toda Posibilidad De Que La Parte Accionada Fuera Vinculada Al Proceso Y Escuchada. Con La Omision De Notificación Tambien Se Violo El Principio De Igualda De Las Partes Ante La Ley Procesal Que Exige El Otorgamiento De Las Mismas Oportunidades Para La Defensa De Sus Intereses. La Sala Considera Que Se Estructuira En El Presente Caso Una Causal De Nulidad Del Proceso. Se Declara La Nulidad De Lo Actuado A Partir Del Auto Admisorio De La Accion De Tutela Y Se Devuelve El Expediente Al Juez De Conocimiento Para Que Tramite El Proceso En Debida Forma
