Agreg\'f3}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11486699,}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 que si se tiene en cuenta que el metro cuadrado del predio tiene un costo de $70.000 la indemnizaci\'f3n debe ser de $2.434\rquote 740.000. \par \par 3}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983\charrsid10445586.-\tab En }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 la sentencia apelada se orden\'f3 imponer la servidumbre de conducci\'f3n de energ\'eda el\'e9 ctrica sobre la franja de terreno del predio mencionado en el numeral 1\'b0; se orden\'f3 a la demandada permitir el libre acceso de los representantes y agentes del actor a la zona para cumplir con la conducci\'f3n de energ\'eda el\'e9ctrica }{ \rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11486699 y dem\'e1s funciones relacionadas; se}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 prohibi\'f3 a la demandada y a sus causahabientes a cualquier t\'edtulo la siembra de \'e1 rboles que puedan alcanzar las l\'edneas o instalaciones de la demandante e impedir la ejecuci\'f3n de obras que obstaculicen el libre ejerci}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11486699 cio del derecho de servidumbre; y se conden\'f3 }{ \rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 a la demandante al pago de $9\rquote 682.500 a favor de la demandada, como indemnizaci\'f3n de perjuicios causados con ocasi\'f3n de la}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11486699 imposici\'f3n de la servidumbre}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983. \par }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11486699 \par }\pard \ltrpar\qc \li0\ri0\sa120\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11486699 {\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \b\f37\fs24\insrsid11486699 II.}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \b\f37\fs24\insrsid11486699\charrsid11486699 FUNDAMENTOS DEL FALLO RECURRIDO \par }\pard \ltrpar\qj \li0\ri0\sa120\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10749983 {\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 \par Para arribar a }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11486699 la prenotada}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 determinaci\'f3n, la juez}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11486699 a}{ \rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \i\f37\fs24\insrsid10749983 a quo }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 expres\'f3 que los motivos para la imposici\'f3 n de la servidumbre son de inter\'e9s social, porque con ello se pretende ejecutar proyectos de distribuci\'f3n de energ\'eda el\'e9ctrica, como es el denominado \'93Proyecto Bacat\'e1-Suba y Noreste Techo (tramo nuevo)\'94, el cual tiene licencia ambiental concedida por {\*\xmlopen\xmlns2{\factoidname PersonName}{\xmlattr\xmlattrns0{\xmlattrname ProductID}{\xmlattrvalue la CAR}}}la CAR{\*\xmlclose} de Cundinamarca. \par \par Respecto de la indemnizaci\'f3n de perjuicios, se\'f1al\'f3 que si bien el perito designado los tas\'f3 en $260\rquote 865.000, la objeci\'f3n propuesta por el actor estaba llamada a prosperar, }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11486699 en consideraci\'f3n a que}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 el perito no explic\'f3 la metodolog\'eda empleada para obtener dicho resultado}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11486699 y }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 que el segundo dictamen (practicado como prueba de la objeci\'f3n) tampoco }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11486699 aport\'f3 mayores luces. }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 \par }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid8727625 \par }\pard \ltrpar\qc \li0\ri0\sa120\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid8727625 {\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \b\f37\fs24\insrsid8727625\charrsid8727625 III.
EL RECURSO DE APELACI\'d3N \par }\pard \ltrpar\qj \li0\ri0\sa120\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10749983 {\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 \par }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid8727625 L}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 a demandada apel\'f3 el aludido fallo, }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid8727625 bajo el argumento}{ \rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 que si bien no se opon}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid8727625 e}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 a la imposici\'f3n de la servidumbre, s\'ed controvierte la indemnizaci\'f3n decretada por {\*\xmlopen\xmlns2{\factoidname PersonName}{\xmlattr\xmlattrns0{\xmlattrname ProductID}{\xmlattrvalue la Juez}}}la Juez{\*\xmlclose} }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \i\f37\fs24\insrsid10749983 quo, }{ \rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 pues en la sentencia se dejaron de tener en cuenta aspectos tales como la imposibilidad para explotar econ\'f3micamente el predio por la existencia de torres de conducci\'f3n de energ\'ed a; que los da\'f1os no son de car\'e1cter temporal sino permanentes dado el riesgo que entra\'f1a la actividad para la cual se impuso la servidumbre. \par \par Agreg\'f3 que los dos peritos coincidieron en se\'f1alar en qu\'e9 consist\'edan los perjuicios que ocasionar\'eda la servidumbre sobre el }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid8727625 inmueble}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 del apelante y que no se tuvo en cuenta que el segundo dictamen acude no s\'f3lo a la comparaci\'f3n de precios; que se pas\'f3 por alto que los peritos conceptuaron que no pod\'eda apreciarse \'fa nicamente la franja de terreno que ser\'eda afectada con la servidumbre, sino }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10551897 el predio }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 como un}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10551897 todo}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983. }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10551897 Por \'faltimo}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 aleg \'f3 que no era posible que el Juzgado tuviera en cuenta para tasar la indemnizaci\'f3n el \'e1rea total afectada del predio, cuyo costo del metro cuadrado ascend\'eda a $50.000}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid2753924.oo}{ \rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 para tan s\'f3lo r}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid2753924 econocer la suma de $9\rquote 682.500.oo}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 \par \par }\pard \ltrpar\qc \li0\ri0\sa120\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10749983 {\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \b\f37\fs24\insrsid10749983\charrsid10445586 CONSIDERACIONES \par }\pard \ltrpar\qj \li0\ri0\sa120\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10749983 {\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 \par }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983\charrsid10445586 1.\tab Cumplidos los presupuestos de orden procesal y comprobada la ausencia de vicios con idoneidad anulatoria, se procede a resolver el recurso interpuesto. \par }\pard \ltrpar\qj \li709\ri0\sa120\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin709\itap0\pararsid10749983 {\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983\charrsid10445586 \par }\pard \ltrpar\qj \li0\ri0\sa120\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10749983 {\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983\charrsid10445586 2.\tab }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 No se discuten los motivos de utilidad p\'fablica para la imposici\'f3n de la servidumbre de conducci\'f3n de energ\'eda el\'e9 ctrica a favor de CODENSA S.A. E.S.P., sobre el predio de propiedad de la demandada que se describi\'f3 en el libelo incoativo.
La apelaci\'f3n se circunscribe a la inconformidad con la indemnizaci\'f3n decretada por {\*\xmlopen\xmlns2{\factoidname PersonName}{\xmlattr\xmlattrns0{\xmlattrname ProductID}{\xmlattrvalue la Jueza}}}la Juez}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10551897 a}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 {\*\xmlclose} }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \i\f37\fs24\insrsid10749983 a quo }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 que considera la demandada es \'ednfima y que no tiene en cuenta aspectos como la }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10551897 peligrosidad de la actividad para cuyo desarrollo se impuso la servidumbre}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 y el menoscabo a la producci\'f3n econ\'f3mica del bien afectado }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10551897 por ella}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983. \par \par Es de anotar que al actor incumbe aportar el inventario de los da\'f1os que se causaren por cuenta de la imposici\'f3n de la servidumbre y el t\'edtulo que representa el dinero correspondiente a dicha indemnizaci\'f3n (art. 27 Ley 56 de 198}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10551897 1}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 y art. 2\'b0 Decreto 2580 de 1985). \par \par En el caso concreto, }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid2753924 la demandante}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 tas\'f3 los perjuicios en $9\rquote 119.289 y para el efecto aport\'f3 copia de un aval\'fa o realizado por una entidad especializada, en el que se }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11145771 tom\'f3 como base }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11757515 para el}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11145771 c\'e1lculo}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11757515 de la indemnizaci\'f3n}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid11145771 el \'e1rea de terreno sobre la cual se impuso la servidumbre}{ \rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f37\fs24\insrsid10749983 ({\*\xmlopen\xmlns2{\factoidname metricconverter}{\xmlattr\xmlattrns0{\xmlattrname ProductID}{\xmlattrvalue 1.291 metros }{\rtlch\fcs1 \ai\af0\afs24 \ltrch\fcs0 \i\f37\fs24\ul\insrsid3167246 y otros perjuicios de elementos no visibles como los campos magn\'e9 ticos formados por los cables de alta tensi\'f3n al ser atravesados como conductores por una corriente de alto voltaje, campos magn\'e9ticos y corrientes el\'e9ctricas que afectan e influyen perjudicialmente en toda la extensi\'f3n del predio (\'85 ) como
