ARTICULO 1° Apruébase el Acuerdo número 175 del 25 de febrero de 1988, adoptado por la Junta Directiva de los Ferrocarriles Nacionales de Colombia en su Sesión número 805 y cuyo texto es el siguiente: FERROCARRILES NACIONALES DE COLOMBIA ACUERDO NUMERO 175 DE 1988 (febrero 25) "por el cual se reforma el estatuto orgánico de los Ferrocarriles Nacionales de Colombia". La Junta Directiva de los Ferrocarriles Nacionales de Colombia, en uso de las facultades de dirección y administración y en especial de las establecidas en el literal b) del artículo 26 del Decreto 1050 de 1968, en concordancia con el artículo 8°Clase A, literal a) del Estatuto Orgánico de los Ferrocarriles Nacionales de Colombia, y CONSIDERANDO: Que el régimen legal vigente, artículo 5°del Decreto 3135 de 1968 y Decreto reglamentario 1848 de 1969, prevé que en los estatutos de las Empresas Industriales y Comerciales del Estado se haga la clasificación de los Empleados Públicos y de los Trabajadores Oficiales al servicio de esas entidades en razón de las actividades de dirección o confianza que desempeñen, ACUERDA: Artículo 1°El artículo 27 del Estatuto Orgánico de los Ferrocarriles Nacionales de Colombia, quedará así: "Artículo 27. Las personas que trabajen al servicio de la Empresa, con las excepciones que a continuación se precisan, son trabajadores oficiales vinculados a ella por contrato de trabajo. Se exceptúan, además del Gerente General, las personas que ejercen actividades de dirección o confianza correspondientes a los siguientes cargos, las cuales tienen carácter de empleados públicos de libre nombramiento y remoción del Gerente General. Así mismo son empleados públicos aquellas personas que desempeñen los cargos de dirección o confianza que se llegaren a establecer mediante cualquier reestructuración de la planta de personal y que sustituyan los que por el presente Acuerdo se precisan como tales". Artículo 2°El presente Acuerdo subroga íntegramente el Acuerdo número 126 de 1987. En consecuencia, la falta de mención de algunos cargos y actividades que según el mencionado Acuerdo 126 debían ser desempeñados por empleados públicos, obedece a que ellos han sido suprimidos de la planta de personal y no significa modificación alguna del carácter de empleados públicos de quienes los desempeñaron. Artículo 3°El presente Acuerdo requiere para su validez la aprobación del Gobierno Nacional.

ARTICULO 2° El presente Decreto rige a partir de su publicación. Publíquesey cúmplase.
