Que la Ley 48 de 1983 creó el Certificado de Reembolso Tributario -CERT-, como un instrumento flexible de apoyo a las exportaciones cuyos niveles fijará el Gobierno Nacional en cualquier momento, de acuerdo a los productos y a las condiciones de los mercados a que se exporten;

Que los artículos 4º de la Ley 48 de 1983 y 7º de la Ley 7º de 1991, establecen que el Gobierno Nacional a través del CERT podrá estimular las exportaciones mediante la devolución de sumas equivalentes a la totalidad o a una porción de los impuestos indirectos pagados por el exportador y promover aquellas actividades que tiendan a incrementar el volumen de exportaciones;

Que el Gobierno Nacional considera conveniente modificar los niveles porcentuales del CERT establecidos en el Decreto 446 de 1992, con el fin de liberar recursos para distribuir en algunos sectores exportadores en crisis;

Que para la vigencia presupuestal de 1996, el Gobierno Nacional mediante la Ley 224 de 1995 apropió la suma de $100.195.510.000 para el CERT, en el rubro "Mecanismos de promoción y difusión para desarrollo para el del comercio exterior".

Artículo 1º

º. Modifícase el artículo 1º del Decreto 446 de 1992, que en consecuencia quedará así: "Las exportaciones de los productos que clasifican por los siguientes capítulos, partidas y subpartidas del Arancel de Aduanas, que se embarquen a partir de la fecha de vigencia del presente Decreto, tendrán los niveles porcentuales del Certificado de Reembolso Tributario -CERT- que a continuación se indican según Parágrafo 1

Las exportaciones de los productos que clasifican por la subpartida 17.01.11.90.00 del Arancel de Aduanas, que se embarquen a partir de la fecha de vigencia del presente Decreto, tendrán los siguientes niveles porcentuales de CERT, según el país de destino: Panamá, Aruba, Bonaire y Curacao 2,25 Cuota de exportación a los Estados Unidos 0,00 Resto de exportación a los Estados Unidos 2,25 Resto del mundo 2,25

Parágrafo 2

Las exportaciones de pasta de cacao con azúcar u otros edulcorantes añadidos que clasifican por la partida 18.06 del Arancel de Aduanas, no tendrán derecho a CERT, cualquiera que sea su país de destino.

Parágrafo 3

Las exportaciones de las hullas bituminosas coquizables que clasifican por la subpartida 27.01.12.00.90 del Arancel de Aduanas, que se embarquen a partir de la fecha de vigencia del presente Decreto, tendrán un nivel de CERT de 3,60%, cualquiera que sea su país de destino.

Parágrafo 4

Las exportaciones de los productos que clasifican por las subpartida 30.04.50.10.00 y 30.04.90.29.90 del Arancel de Aduanas, que se embarquen a partir de la fecha de vigencia del presente Decreto, cualquiera que sea su país de destino, tendrán un nivel de CERT de 4,50% cuando se envasen en cápsulas de gelatina y de 2,25% cuando se presenten en otros envases.

Parágrafo 5

Las exportaciones de vehículos de combate que clasifican por la partida 87.10 del Arancel de Aduanas, no tendrán derecho a CERT, cualquiera que sea su país de destino.

Artículo 2

º . Las exportaciones de los productos que clasifican por los siguientes capítulos, partidas y subpartidas del Arancel de Aduanas, que se embarquen a partir de la fecha de vigencia del presente Decreto y Parágrafo 1

Exceptúanse de lo previsto en el presente artículo las exportaciones de los productos que clasifican por las subpartidas 49.07.00.20.00 y 49.07.00.30.00 del Arancel de Aduanas, las cuales no tienen derecho a CERT de conformidad con lo señalado en el artículo 1º de este Decreto.

Artículo 3

º . El Gobierno Nacional evaluará periódicamente la ejecución del presupuesto para el CERT con el fin de revisar los niveles otorgados en los artículos 1º y 2º de este Decreto, si ello fuere necesario.

Artículo 4º

º. Las exportaciones de los productos que clasifican por las siguientes subpartidas arancelarias, que se embarquen a partir de la fecha de vigencia del presente Decreto y hasta el 31 de diciembre de 1996, tendrán los niveles porcentuales del Certificado de Reembolso Tributario, CERT, que a continuación se indican según el país de destino: PANAMA, ARUBA BONAIRE Y CURACAO ESTADOS UNIDOS Y PUERTO RICO RESTO DEL MUNDO 0803001200 0,00 1,50 3,00 0803001910 0,00 1,50 3,00 0803001990 0,00 1,50 3,00

Parágrafo

El Gobierno Nacional evaluará periódicamente el comportamiento de las exportaciones, la evolución de los precios internacionales y la ejecución del presupuesto CERT de los productos mencionados en el presente artículo, con el fin de revisar los niveles porcentuales otorgados en el mismo si ello fuere necesario.

Artículo 5º

º. Las exportaciones de los productos que clasifican por los capítulos, partidas y subpartidas del Arancel de Aduanas enumerados en los artículos 2º y 4º del presente Decreto, destinadas a México, tendrán los niveles porcentuales de CERT establecidos en el artículo 1º de este Decreto.

Artículo 6º

º. Las disposiciones establecidas en los artículos 1º, 2º y 4º de este Decreto no se aplicarán a las exportaciones destinadas a Bolivia, Ecuador y Venezuela.

Artículo 7º

º. A partir del 1º de enero de 1997, las exportaciones de los productos de que tratan los artículos 2º y 4º del presente Decreto, tendrán los niveles porcentuales de CERT establecidos en el artículo 1º de este Decreto.

Artículo 8º

º. El presente Decreto rige a partir de la fecha de su publicación.
